1. Introduction

These Terms & Conditions govern the provision of services by Grave Care & Memorial Maintenance Services (“the Company”, “we”, “our” or “us”) to our clients.

By requesting a quotation, accepting a quotation or making use of our services, you agree to these Terms & Conditions.


2. Our Services

We provide professional memorial care services including, but not limited to:

  • Initial site inspections
  • Grave cleaning
  • Memorial maintenance
  • Granite cleaning and polishing
  • Floral tributes
  • Memorial restoration
  • White decorative stone installation
  • Memorial inscription management
  • GPS grave location recording
  • Before-and-after photographic reports
  • Cemetery location assistance
  • Other related memorial services

3. Quotations

All quotations:

  • Are valid for 30 days, unless otherwise stated.
  • Are based on information available at the time of inspection.
  • May change should additional work be required.
  • Are subject to site conditions and cemetery regulations.

Acceptance of a quotation constitutes acceptance of these Terms & Conditions.


4. Payment Terms

Unless otherwise agreed in writing:

  • Payment is due in advance before services commence.
  • Monthly maintenance plans are payable in advance.
  • No services will be rendered on overdue accounts.
  • Interest may be charged on overdue accounts where permitted by law.

Ownership of any materials supplied remains with the Company until payment has been received in full.


5. Site Access

The client is responsible for providing accurate information regarding:

  • Cemetery name
  • Grave number (where available)
  • Section
  • Memorial details
  • Contact information

Where the grave location is unknown, our Grave Location Assistance Service may be offered at an additional cost.


6. Cemetery Regulations

All work is performed subject to the rules and regulations of the relevant cemetery authority.

The Company shall not be responsible for delays resulting from:

  • Restricted access
  • Cemetery closures
  • Municipal requirements
  • Religious ceremonies
  • Maintenance restrictions

7. Weather Conditions

Services may be postponed where weather conditions make work unsafe or unsuitable.

This includes:

  • Heavy rain
  • Strong winds
  • Flooding
  • Extreme temperatures

Services will be rescheduled at the earliest practical opportunity.


8. Memorial Condition

Many memorials are decades old and may have existing deterioration.

Although every reasonable precaution is taken, the Company cannot accept liability for damage resulting from:

  • Existing structural weaknesses
  • Loose memorial components
  • Age-related deterioration
  • Hidden defects
  • Previous poor workmanship

Where concerns are identified, these will be communicated to the client before work proceeds where reasonably possible.


9. Before-and-After Photographs

Photographs may be taken:

  • Before work commences
  • During maintenance
  • After completion

These photographs form part of our quality assurance process and may be supplied to clients.

Photographs will not be used publicly without the client’s consent.


10. Memorial Inscriptions

Clients are responsible for verifying the spelling, dates and wording of all inscriptions before work is undertaken.

The Company cannot accept responsibility for incorrect information supplied by the client.


11. Flowers and Decorations

Fresh flowers, artificial flowers and decorative items are supplied subject to seasonal availability.

Natural flowers have a limited lifespan and the Company cannot guarantee how long they will remain in good condition after placement.


12. Limitation of Liability

To the fullest extent permitted by law, the Company’s liability shall be limited to the value of the services provided.

The Company shall not be liable for:

  • Indirect loss
  • Consequential damages
  • Emotional distress
  • Loss arising from incorrect information supplied by third parties
  • Damage caused by vandalism, theft, weather or natural deterioration occurring after completion of the service

13. Cancellation Policy

Clients may cancel scheduled services by providing reasonable notice.

Where materials have already been purchased or work has commenced, reasonable costs incurred may be deducted from any refund.


14. Monthly Maintenance Plans

Maintenance plans are ongoing service agreements.

Clients may cancel by providing at least 30 days’ written notice.

No refunds will be provided for services already rendered.


15. Privacy

Personal information is processed in accordance with:

  • The Protection of Personal Information Act (POPIA)
  • Our Privacy Policy
  • Our POPIA Notice

16. Intellectual Property

All photographs, reports, website content, branding, logos and documents remain the property of Grave Care & Memorial Maintenance Services unless otherwise agreed in writing.


17. Governing Law

These Terms & Conditions shall be governed by the laws of the Republic of South Africa.

Any disputes shall be subject to the jurisdiction of the South African courts.


18. Changes to these Terms

We reserve the right to amend these Terms & Conditions from time to time.

The latest version will always be published on our website.

20. Right to Refuse Service

Grave Care & Memorial Maintenance Services reserves the right to refuse or discontinue services where:

  • Conditions at the memorial pose a safety risk.
  • Access to the memorial cannot reasonably be obtained.
  • The requested work may damage the memorial.
  • Outstanding amounts remain unpaid.
  • The requested service would be unlawful or contrary to cemetery regulations.
